Tueth Keeney attorneys including Tom Tueth successfully defended a boundary dispute lawsuit which had been filed against both the Northwest R-I School District and the Rockwood R-VI School District. Plaintiffs alleged that they lived on a parcel of land that had never been incorporated or annexed into an existing school district. In their lawsuit, Plaintiffs requested that the Court declare their property to be in the Rockwood School District. However, both Districts agreed that the Plaintiffs”™ property was part of the Northwest R-I School District. Firm attorneys Thomas E. Tueth and Stephanie Tueth Reh represented both Districts in Jefferson County Circuit Court.
The Plaintiffs, parents of two children who were attending the Northwest R-I School District, had informally attempted to have both Districts declare that their property was part of the Rockwood R-VI School District, not the Northwest R-I School District, numerous times prior to filing the lawsuit. Both Districts repeatedly denied the Plaintiffs”™ requests, and Plaintiffs filed suit. Tueth Keeney attorneys filed a Motion for Summary Judgment on behalf of both School Districts, arguing that the property was part of Northwest R-I School District as a matter of law.
Tom offered the argument that the Jefferson County Assessor’s Office had placed Plaintiffs”™ property in the Northwest R-I School District since the inception of the District in 1950. This evidence convinced Circuit Judge Dennis Kehm that Plaintiffs”™ property was part of the Northwest R-I School District. Accordingly, on January 26, 2005, the Hon. Dennis Kehm granted Defendants”™ Motion for Summary Judgment and ruled that, as a matter of law, the Plaintiffs”™ property is located in the Northwest R-I School District and not the Rockwood R-VI School District.
