Rob Jackstadt and John Reynolds Obtain Dismissal of Construction Litigation Claims Against Kansas City Area School District

Tueth Keeney attorneys Robert Jackstadt and John Reynolds recently obtained the dismissal of a lawsuit filed against a Kansas City area school district. The Plaintiff in the lawsuit, a construction company, alleged that the school district had failed to fully pay Plaintiff for work performed. The lawsuit had been pending against the District for several years, and Plaintiff had been through two attorneys. After the second attorney for Plaintiff withdrew from the case, Plaintiff failed to secure new counsel. On behalf of the defendant school district, Tueth Keeney attorneys then argued that, under Missouri law, a corporation cannot represent itself in a lawsuit; it must have legal counsel. On January 26, 2005, the Judge accepted this argument, and dismissed the case against the District.

Robert Jackstadt is a founding Shareholder of the Firm of Tueth, Keeney, Cooper, Mohan & Jackstadt, P.C. Prior to founding the Firm, Rob was a partner at Blackwell Sanders Peper Martin in its St. Louis office. Rob serves on the Firm’s Management Committee. Rob is a former member of the Edwardsville School Board, a former trustee and planning commission member for the Village of Glen Carbon and is currently the Mayor of the Village of Glen Carbon- a part time position.

Rob practices in the areas of commercial, construction and education litigation. Rob has tried to a conclusion many jury and non-jury cases in federal and state courts located in Illinois and Missouri. Rob’s trial experience includes litigation involving tax increment financing (“TIF”) districts, equipment leases, condemnation, construction, performance and payment bonds, non-competition agreements, securities and mechanic’s liens. Rob has negotiated many construction contracts, including architect agreements, construction manager agreements, and general contractor agreements.

John M. Reynolds is a shareholder in the firm and has extensive practice as a litigator before the Missouri and Federal Bar. John’s litigation focuses on several areas: Construction Litigation, Commercial Lease Disputes, Product Liability Litigation, Education Litigation and Business Litigation.
