On December 1, 2020, a federal judge struck down the policies proposed by the Department of Labor and Department of Homeland Security regarding H-1B visa holders, finding the policies were created in violation of the Administrative Procedure Act (“APA”). The first policy, unveiled by the Department of Labor on October 6, 2020, proposed to increase wages for foreign workers based on surveys of salaries in each profession. The second policy, published by the Department of Homeland Security on October 8, 2020, proposed several new measures focused on tightening the regulatory definition of a “specialty occupation” and limiting placements at third-party worksites. Although the agencies argued their policies were justly created under the APA’s “good cause exception” in light of the COVID-19 pandemic and corresponding unemployment, the Court found this argument unconvincing and pointed out that the agencies waited six months to take action and its factual basis for use of the exception was sparse.

Ms. Metzger also assists corporate clients with preventive advice and counsel, including advice on immigration-related corporate reorganization issues and corporate compliance & due-diligence matters including, I-9s, E-Verify, and immigration-related audits. Ms. Metzger regularly provides training to her clients.
