On February 19, 2008, the United States Court of Appeals for the Eighth Circuit entered an order summarily affirming the Order of the United States District Court for the Eastern District of Missouri, which entered summary judgment in favor of the City of St. Charles School District.

Plaintiff claimed that the District discriminated against him on the basis of race, age, and sex when it did not hire him for a position in the District. The District Court entered summary judgment in favor of the school district on April 2, 2007, finding that the plaintiff had failed to offer any evidence of discrimination on the basis of race, age or sex.
